Marietta man convicted of abusing wife for the ninth time

MARIETTA, GA (CBS46) -

On Thursday, a Cobb County jury convicted a Marietta man accused of beating his wife, leading to his fourth stay in state prison.

The jury deliberated for two hours then convicted Ricky Allen, 39, of family violence battery, aggravated battery and false imprisonment. However, the jury acquitted Allen of the kidnapping charge.

Throughout the trial, the jury saw and heard evidence of spousal abuse that Allen inflicted in an attack on June 2013. At that time, Allen threw his wife onto a concrete floor and punched her.

Allen's wife testified at the trial, but recanted the intensity of the attack.

Cassi Haberler, family violence director at the YWCA of Northwest Georgia, testified as an expert witness for the prosecution. She described Allen as "a classic domestic violence abuser" whose violent behavior had escalated over the couple's 10 years of marriage.

Allen's wife has filed for divorce, said Assistant District Attorney Sherwin Figueroa. But indicated that this is the first step in a long process.

"Unfortunately, she's still under his power and control," ADA Figueroa said. "His behavior controls her and makes her do things a normal person would not do. She believed she had to recant or her life would be in danger."

Allen will be sentenced by Cobb Superior Court Judge S. Lark Ingram at a later date; he faces a maximum of 30 years in prison. Allen has been convicted of abusing his wife eight different times. Only one of those was a felony conviction.
