A Phoenix man with two previous drunken driving convictions is facing a second-degree murder charge in a wrong-way freeway crash that killed a New York woman last month.

Benjamin Charles Kuzelka, 27, was arrested after being released from John C. Lincoln North Mountain Hospital, Arizona Department of Public Safety officials said Thursday.

He had been recovering from injuries sustained in the Oct. 6 accident that killed 55-year-old Mary A. Boysman of Oswego, NY.

DPS officials said Boysman was a passenger in an SUV that was struck head-on by a vehicle driving in the wrong direction on State Route 51.

The two vehicles spun clockwise 90 degrees before coming to rest just a few feet from the area of impact, DPS said. 

The driver of the SUV was seriously injured and hospitalized for four days.

Kuzelka had a initial blood alcohol content of .281, more than three times the legal limit, according to the police report.

Police said Kuzelka's driving record in California showed he was convicted of drunken driving on March 16, 2007 and on Oct. 31, 2007.

Kuzelka faces one count of second-degree murder, aggravated assault, endangerment, aggravated DUI and criminal damage.
