Reese Witherspoon issues apology after arrest in Atlanta

Nashville native Reese Witherspoon has issued an apology after she and her husband, James Toth, were arrested in Atlanta early Friday morning.  

Witherspoon released a statement late Sunday saying she was sorry for her "disrespectful" behavior to police.

Witherspoon said she was worried about her husband and "clearly had one drink too many" but asserted her respect for law enforcement in the statement released by her Los Angeles-based spokeswoman, Meredith O'Sullivan Wasson.

The actress and her agent husband were arrested and briefly jailed after he was pulled over for suspicion of driving while intoxicated.

Toth is charged with driving under the influence and failure to maintain a lane while driving.

According to police reports, Witherspoon was arrested on a disorderly conduct charge after repeatedly disobeying officer instructions.

The arresting officer wrote in his report that while he was conducting Toth's field sobriety test, "Mrs. Witherspoon began to hang out the window and say that she did not believe that I was a real police officer."

The officer alleges that although he repeatedly asked Witherspoon to stay in the vehicle, she exited the car and told him "'that she was a 'U.S. citizen' and that she was allowed to 'stand on American ground.'"

During her arrest for disorderly conduct, the officer says, "Mrs. Witherspoon asked, 'Do you know my name?' I answered, 'No, I don't need to know your name.' I then added, 'Right now.' Mrs. Witherspoon stated, 'You're about to find out who I am.'" "Mrs. Witherspoon also stated, 'You are going to be on national news.' I advised Mrs. Witherspoon that was fine."

Witherspoon and Toth married in March 2011.

The Oscar-winning actress is currently shooting the indie drama The Good Lie in Atlanta. In 2005, Witherspoon won an Academy Award for Best Actress for her role as June Carter Cash in Walk the Line.

A court hearing that was scheduled for Monday was reset for May 22.
