Suit dismissed over Yuma councilmen recall effort

YUMA, AZ (AP) -

A lawsuit filed against Yuma and Yuma County by a group trying to recall two city councilmen has been dismissed.

Recall Them All 2012 was attempting to get recall elections for Paul Johnson and Jerry Stuart, whose terms expire at the end of this year.

The group claims some council members have abdicated their responsibilities to Yuma residents.

The recall petitions were rejected in July for lacking the required 1,856 valid signatures for each councilman and the group later sued.

Yuma Superior Court Judge John Nelson signed the dismissal order Monday, stipulating each party is responsible for its own legal costs.

The dismissal is with prejudice, meaning the issue cannot be brought up again.

City officials say they agreed to a dismissal to save further taxpayer money in defense costs.
