The sheriff of Linn County sent a letter to Vice President Joe Biden informing him he will not enforce any gun laws he deems unconstitutional.
In a letter dated Jan. 14 and sent to 1600 Pennsylvania Ave. in Washington D.C., Linn County Sheriff Tim Mueller wrote politicians are attempting to exploit the deaths of innocent victims in recent criminal events.
"It all started because my deputies and I were getting questions out there from people in the community wanting to know what my position was," Mueller said.
Gun dealers in Linn County said they were pleased to see Mueller take the stance he did.
"It's a pretty amazing letter, really, coming from a government official," said Nick Russell, owner of Albany Guns, Coins and Jewelry. "He's kind of saying what a lot of us think."
Mueller wrote honest and law-abiding people should not be prevented from owning certain types of guns or ammunition magazines.
"Any federal regulation enacted by Congress or by executive order of the president offending the constitutional rights of my citizens shall not be enforced by me or by my deputies," Mueller wrote. "Nor will I permit the enforcement of any unconstitutional regulations or orders by federal officers within the borders of Linn County, OR."
Mueller spoke to Fox 12 the day before President Barack Obama, with Biden by his side, announced a $500 million plan that would ban military-style assault weapons and high-capacity ammunition magazines.
The sheriff wrapped up his letter by making clear his feelings on legislation like the president's proposal.
"In summary, it is the position of this sheriff that I refuse to participate, or stand idly by, while my citizens are turned into criminals due to the unconstitutional actions of misguided politicians."
Mueller said he isn't sure if anyone in the White House will actually see his letter, but it's gone viral online and the sheriff is just pleased to at least see some important conversations taking place about our gun laws.
"If I could ask for anything to come out of this is just to get people talking about it," he said.
