PHOENIX (CBS5) -
A Phoenix area firearms company must pay $70,000 after failing to provide promised goods and services to dozens of customers.
Attorney general Tom Horne has obtained a consent judgment against Lancaster Arms to settle allegations that the company violated the Arizona Consumer Fraud Act.
A lawsuit filed in Dec. 2011 alleged Lancaster Arms owner Chester Durda represented to consumers the company would provide weapons and weapon services to consumers who, collectively, paid thousands of dollars in advance, and subsequently failed to do so. The company is also accused of failing to honor its "limited lifetime warranty" by failing to repair weapons returned by consumers.
Lancaster Arms is now being forced to pay $67,000 in restitution to 48 consumers, $3,000 to cover the state's costs in bringing the case and the company is being forced to comply with the Arizona Consumer Fraud Act.
