PD: Man arrested for creating fake video as evidence

GILBERT, AZ (CBS5) -

A man arrested by Gilbert police for drunk driving, and later released, has been arrested again after investigators learned the video he submitted as evidence was fabricated.

Sgt. Bill Balafas with the Gilbert Police Department said Rex Altree, 56, was arrested for extreme DUI on Sept. 1, 2010.

During the court hearings, Altree submitted a video he claimed was taken the day of his arrest, which led to the case being dismissed in November 2011.

The officer who made the original arrest didn't think the video looked right and the video was sent to the forensic computer analyst in the Criminal Investigations Department. The exam showed the dates and times had been altered on the video.

Altree was arrested at the Gilbert Municipal Court for multiple felony charges related to the video following his guilty plea on the extreme DUI charge.

Altree's charges of perjury, forgery, tampering with physical evidence and obstructing a criminal investigation have been sent to the Maricopa County attorney's office.
