AZ measure on states' rights won't be on ballot

PHOENIX (AP) -

An initiative campaign for an Arizona ballot measure on states' rights has failed.

Secretary of State Ken Bennett's office says checks of petitions submitted by supporters produced 183,000 valid signatures. That's well short of the required 259,000.

The so-called "Checks and Balances" proposal would have set the stage for possible constitutional challenges to actions by the federal government.

Business Jack Biltis led and bankrolled the campaign. He says it was a valiant effort to take a stand for fellow citizens.

But that he says he knows his effort started relatively late and that he's accepting the determination Friday that the petition drive fell short.

The measure sought to allow the state to "reject" any federal action that either the voters or the Legislature and the governor deem to be unconstitutional.
