Order on analysis of sales tax initiative upheld

PHOENIX (AP) -

The Legislature will have to make several changes to its official description of a sales tax initiative headed to Arizona's November ballot.

A panel of three Arizona Supreme Court justices upholds a judge's ruling that parts of the official publicity pamphlet's description of the initiative fall short of being an impartial analysis.

Under the Supreme Court panel's order Friday, the description must note that the proposed penny-on-the-dollar increase would take effect when an earlier temporary increase expires.

Other provisions needing to be deleted or revised deal with the Legislature's ability to change what transactions are taxed and who qualifies as a resident for scholarships funded by the proposed tax increase.

Initiative supporters sued to challenge the description approved by a joint House-Senate committee, the Legislative Council.
