GAINESVILLE, GA (CBS ATLANTA) -

A Gainesville teen is under arrest and has been charged as an adult in a child molestation case.

On July 30 around 5 a.m., the mother of a 5-year-old girl went in to check on her and found 15-year-old Daniel Lee Eller of Gainesville in the act of molesting her, according to Gainesville police.

Police said Eller was intoxicated and had entered the home on Fran Mar Drive through an unlocked window.

The mother then alerted the girl's father, who confronted Eller and detained him until deputies arrived.

Eller was arrested and taken to Northeast Georgia Medical Center, where he was treated for minor injuries. He was then booked into the Gainesville Regional Youth Detention Center, initially charged with child molestation, burglary, and criminal trespass.

On Aug. 6, it was determined that Eller would be charged as an adult. As a result, juvenile charges were dismissed and he was booked into the Hall County Jail with charges of aggravated child molestation and burglary.

He was then taken back to Gainesville RYDC, where he remains without bond.

His next scheduled court appearance is Sept. 6 in the Magistrate Court of Hall County.
