PHOENIX (CBS5) -

Authorities have caught the man they believe shot and killed a 30-year-old Phoenix man while a woman and her children were in the home.

Phoenix Police Officer James Holmes said they found Darnell Pete on July 4, with gunshot wounds to his upper body and he was pronounced dead at the home of Jaime Cabralez in the 1500 block of West Yavapai.

The woman at the home told police she and her two kids had been in a bedroom of the home and didn't witness the shooting or know the victim.

Police arrested Cabralez on Tuesday at his home on first-degree murder, drug charges and a probation violation.

Police believe Pete was at Cabralez's home in part to buy a 15-pound bale of marijuana from Cabralez.

Police said Pete got out a gun and tried to rob Cabralez of the marijuana.

Police said Cabralez shot Pete twice in the head and then fled.

After his arrest on Tuesday, Cabralez said he was on probation at the time of the shooting and legally could not have a gun. He said he paid $4,000 for the marijuana and agreed to sell it to Pete for $5,000.

Cabralez said he shot Pete to protect himself and his family. Cabralez told police he shot Pete once, walked up to him until he was two to four feet away from his head, Pete moved and Cabralez shot him a second time in the head before fleeing, according to police.

Pete died at the scene.
