Family feels deadly shooting was not self-defense, but murder

Back on April 3, initial reports of a deadly shooting outside a Laveen Taco Bell said a man inside his car at the drive-thru was suddenly attacked by Daniel Adkins. The driver said Adkins  began hitting his car with a pipe, then punched him, forcing him to shoot and kill Adkins in self-defense.

"He made my brother look like a complete scary person and my brother was not like that. My  brother was just going to Taco Bell trying to grab something to eat," said Marina Reyes, Daniel's sister.

Reyes said the police investigation has shown those initial stories were wrong and Adkins, who had the mentality of a 13-year-old, never had a weapon of any kind, and he never even touched the car.

"There is no evidence whatsoever that the car was ever touched by my brother, nor was the driver struck," said Reyes.

Police said the driver came around a blind corner and almost hit Adkins leading them to argue.

"My son does have a big mouth he will say something and he might have called him a few bad names," said Daniel Adkins Sr., Daniel's father.

However,  the family feels a verbal argument and Adkins throwing a punch that never actually stuck the driver does not justify murder.

 "I just do not understand why still, a week-and-a-half later, there has not been an arrest done," said Reyes.

The family feels that they have a lot of similarities with the Florida murder case of Trayvon Martin. However, unlike the Martin case, the shooter here has not been identified. The family said  it is unfair that they do not know who the shooter is since they likely live in the same area.

The family also is upset that people in the community are making the shooting about race. They feel that was never a factor and should not be made into an issue after the fact.

CBS 5 News did reach out to Phoenix Police about this case, but all they can say at this time is that it is under investigation and  they are working closely with the Maricopa County Attorney's Office.
