Police: Man shot, killed at Phoenix fast food drive-thru

PHOENIX (CBS5) -

An argument between two men at a Phoenix area drive-thru restaurant ended in a deadly shooting Tuesday night, Phoenix police said.

The victim was identified as 29-year-old Daniel Adkins.

Police said Adkins, who was walking his dog, stepped around a blind corner and into the drive-thru lane of the Taco Bell at 7200 S. 51st Ave.

The driver quickly stopped, exchanged words with Adkins and then shot him once, officers said.  Adkins died at the scene. 

The driver and passenger remained at the scene and called police. Both of them told officers Adkins had swung a bat or some other type of weapon at them. Detectives said they were unable to find the bat or similar item.

An independent witness told investigators that Adkins had swung his fist in the direction of the driver several times.

This case is still ongoing and will be reviewed with the Maricopa County attorney's office.
