Tammi Smith Claims Innocence In Baby Gabriel's Disappearance

Officers have arrested person-of-interest Tammi Smith on Tuesday morning in connection with the disappearance of baby Gabriel Johnson, authorities said. Gabriel disappeared at the end of December in San Antonio, Texas. His mother, Elizabeth Johnson, sits in a Maricopa County jail on charges of kidnapping and custodial interference.

Smith, 37, and her husband, Jack Smith, said they were going to adopt Gabriel, but Johnson's ex-boyfriend, Logan McQueary, would not cooperate.

According to a statement from the Tempe Police Department, Smith was charged with conspiracy to commit custodial interference, custodial interference and forgery.

She was arraigned late Tuesday night and released early Wednesday morning.

"We all knew this would happen," Smith said as she walked into the Fourth Avenue Jail. "I am innocent. God is with me."

Jack Smith maintains his wife's innocence.

"We have been harassed," he said. "We have been bullied, and we know nothing."

He also said he trusts his wife.

"I've known every single thing -- everything all along the way," he said.

Police searched the Smiths' Scottsdale home Jan. 15. At the time, they did not provide any specifics.

Nevertheless, on Tuesday at a new conference, police said some of the evidence they seized during that search helped them build their case against Tammi Smith.

Since the beginning, police have said Tammi Smith was not completely forthcoming in her interviews with officers.

When filing custody paperwork, Johnson listed Craig Cherry as a potential father of her baby; however, Cherry told police that he had never met or spoken with Johnson. Police said they have evidence that Smith filled out the paperwork and knowing her first cousin Cherry could not be the father, put his name down anyway.

Cherry is the one who told police that he was related to Tammi Smith, something which she had never mentioned, police said.

Upon hearing of the arrest, a thrilled McQueary said it was a long time coming, and he has always maintained that Smith knows more than she told police.

He and his family, who are on a road trip to San Antonio to retrace Johnson's steps, said they believe the arrest is another clue that may ultimately help police find Gabriel.

Nevertheless, not all are optimistic that Gabriel is still alive.

Last week, investigators in San Antonio cordoned off an area of a landfill on Tessman Road where they might search for evidence in the case. They would not confirm when or even whether a search of the area would take place.
