Ruling: Teen Fatally Shot By Twin Brother

TUCSON, Ariz. -- A teenager who died last year was shot by his twin brother and did not commit suicide, a judge has ruled.Given the angle of the head wound, there is no way 14-year-old Christopher McIntyre could possibly have shot himself, Pima County Superior Court Judge Virginia Kelly ruled Tuesday.Tyler McIntyre was the only other person in the room at the time of the September 2007 shooting and he initially told police his brother may have been shot during a drive-by shooting.The teen also didn't tell police he'd hidden the gun under a couch cushion until he was confronted.Kelly adjudicated Tyler McIntyre delinquent on the charge of manslaughter and scheduled his sentencing for July 10.He could be put on probation, placed in a residential treatment center or sent to the Arizona Department of Juvenile Corrections until his 18th birthday, according to the judge.Court documents show the twins had been arrested in the past and had a troubled family life. Both were on probation in the year before the shooting.
