UPDATED: 5:08 pm MST August 25, 2007

A baby who was hospitalized after allegedly being abused by his father has died and the father now faces a murder charge.

Two-month-old Gregory Friederich died at St. Joseph's Hospital in Phoenix Friday afternoon, two days after his father brought him to the emergency room saying the baby was listless and wouldn't eat.

Gregory Marshall McMillan, 21, of Mesa, admitted to the abuse, police said.

The infant suffered a fractured skull, two broken ribs and a lacerated liver, officers said.

He was originally booked for two counts of child abuse. He was returned to Mesa Friday night where the second-degree murder charge was added. He was then re-booked into the Maricopa County Jail.

During an initial appearance on Friday, the judge said if $180,000 bond is posted, McMillan has to be on supervised released.

He told police Thursday he got angry because his son wouldn't stop crying.

Officers said McMillan violently picked up the baby out of his crib and smacked the baby's head.

McMillan then cracked his son's ribs by pressing the baby's legs into his chest while changing his diaper, police said.

McMillan and his girlfriend initially took their son to the hospital after he became lethargic and refused to eat, investigators said.

Doctors examined the boy and called police to report the child's injuries.

McMillan admitted he choked his girlfriend several times after the two began arguing over what had happened to the child, police said.

A status conference has been set For Aug. 30.
